Robert Korn, Esq.
- Attorney Rob Korn has handled more than 1,000 arbitration and mediation matters. As a dispute resolution professional, he has utilized his extensive experience as a trial attorney in resolving commercial disputes. As an active trial attorney, he has litigated commercial disputes, principally arising out of multi-million dollar commercial and institutional construction as well as real estate projects.
- Rob became an arbitrator with the American Arbitration Association in the 1970s. He was selected by the American Arbitration Association as one of only five attorneys in Pennsylvania to serve on its Master Mediator Panel for construction disputes.
- He served on the Large, Complex Panel for Construction Disputes for the American Arbitration Panel.
- Rob serves as a Judge Pro Tempore for the Commerce Court of the Court of Common Pleas of Philadelphia County.
- He also serves as a arbitrator for the United States District Court for the Eastern District of Pennsylvania.
- In the 1990s, he attended a week-long mediator training program at Harvard Law School. He has received extensive training as both an arbitrator and mediator.
Mediation Approach
Rob thoroughly studies all materials submitted to him; he conferences with counsel and decision makers before the mediation is held; at the mediation he listens carefully to the participants to better understand not only the dispute itself but their personal interest in the outcome; he helps the parties focus on the key issues. When appropriate, he transitions from a facilitative to an evaluative approach-becoming evaluative only when the parties expressly agree to such an approach. Closure frequently does not occur at a mediation, and being committed to resolving a dispute, he continues to work with the parties after the formal mediation session to reach closure. He believes an impasse is unacceptable.
